Checking Registration Tax and Product Requirements
Build a dated verification file for the exact business and product before accepting sales.
Build a dated verification file for the exact business and product before accepting sales.
Part 3 of 10 | Turning a Handmade Product into a Small Business
Learning goals
Identify the Gambian authorities relevant to your activity and create a practical verification checklist. Separate business registration, tax registration, local permissions and product-specific requirements. The result is a dated action record showing what is confirmed and what remains unresolved. This lesson does not grant permission to trade or treat a public webpage as a personalised legal ruling.
Before you begin
Write the exact product, intended claims, production location, ownership arrangement and sales method. A handmade bag, a bottled drink and a scalp balm create different questions. Selling from home or through messages does not automatically remove obligations. Complete the relevant checks before taking money or distributing products, including free samples where safety requirements apply. Keep personal identity documents private during the exercises.
Step 1 Check the business structure
The Ministry of Justice Companies Department lists sole proprietorships, partnerships and companies among the categories it registers. Its sole proprietor guidance describes one owner, personal liability, and an SWR 3 application supported by identification and a TIN card. These are starting points checked for this course, not a complete checklist for every applicant. Confirm current documents, fees and arrangements directly before applying.
Choosing a structure affects responsibilities. Do not assume that informal help from a friend makes them a co-owner, or that a business name creates limited liability. Where ownership, debt or investment is involved, obtain suitable professional advice and document the arrangement. Avoid copying an internet partnership agreement without understanding who owns tools, contributes money and makes decisions when something goes wrong.
Step 2 Verify tax obligations with GRA
The Gambia Revenue Authority provides taxpayer registration and domestic tax administration information. Ask GRA which registration, tax category, records, returns and payment dates apply to your actual activity. Business turnover and profit are different figures. A small initial profit is not evidence that no filing or registration duty exists. This course deliberately does not supply a universal VAT threshold, rate or small-business exemption.
Record the official response, date, source and next action. Ask how to present prices and issue receipts under the applicable rules, including whether you should charge any tax. Do not add a line called VAT merely because another shop does. Keep planning calculations separate from the tax treatment confirmed for your business. If information appears inconsistent or outdated, resolve it with the authority rather than selecting the most convenient interpretation.
Step 3 Identify product and premises checks
FSQA operates a food-business registration portal. A maker of drinks, snacks or other food should confirm establishment, hygiene, labelling, storage and inspection requirements with FSQA for the proposed activity. A registration form is not proof that a particular recipe, shelf-life claim or production room is acceptable. Do not borrow an expiry date from a different product.
The Medicines Control Agency states that its mandate includes cosmetics and household chemical substances. For soap, hair butter or similar products, describe the exact formulation, use and claims to MCA and obtain the applicable route. Do not assume the course's personal-use hair butter is ready for sale. Product safety, suitable testing, labelling and any required authorisations need their own assessment; homemade and natural are not exemptions established here.
Also ask the relevant local authority and premises owner what trading, location or tenancy conditions apply. Requirements can depend on place and activity, so this lesson does not invent a nationwide licence fee. Ask about any additional standards or inspections the responsible authority identifies. Record unanswered questions as pending and set a follow-up date.
Step 4 Build an evidence file
For each requirement, record authority, question, dated answer or document, person responsible, deadline and status. Use confirmed, pending or not applicable with a recorded reason. Save official receipts and acknowledgements securely. Do not display identity cards in marketing photographs or share them in group chats. A tidy evidence file helps you distinguish an application submitted from a requirement actually completed.
Guided exercise
1. Prepare a one-paragraph activity description including product, production site, owner and sales channel. Make it specific enough for an authority to answer usefully.
2. Create separate checklist rows for business registration, GRA, local permissions and product-specific checks. Add other rows when official guidance identifies them.
3. Draft questions for the applicable authorities using their official contact routes. This written exercise does not require submitting forms or exposing personal documents.
4. Record the source-check date and identify which public information needs direct confirmation for your situation. Leave unknown fees and tax figures blank with a pending label.
5. Write a launch rule: no sales or product distribution until applicable readiness requirements are resolved and documented. Research and planning may continue meanwhile.
Knowledge check
1. Does a business certificate establish food or cosmetic product safety?
2. Can every small maker use the same tax rate and filing schedule?
3. Is an application submitted the same as an approval received?
Answer guide
1. No. Product and premises obligations are separate.
2. No. Confirm the treatment of the actual business with GRA.
3. No. Record each stage accurately and obtain the relevant confirmation.
Completion standard
Produce the activity description and a dated verification register with responsible authorities, sources and next actions. Written completion is possible with pending items, but commercial launch remains pending until applicable requirements are met. No invented fee, exemption or approval may appear in the file.
